  35.    Federal Court Partially Enjoins the CDA
  36.    EPIC

  38.           U.S. District Judge Ronald L. Buckwalter of Philadelphia has
  39.           issued a partial temporary restraining order prohibiting
  40.           enforcement of the "indecency" provision of the Communications
  41.           Decency Act (CDA). The judge declined to enjoin those
  42.           provisions of the Act dealing with "patently offensive"
  43.           communications.
  44.  
  45.           The court agreed with the plaintiffs' claim that the CDA will
  46.           have a chilling effect on free speech on the Internet and found
  47.           that the CDA raises "serious, substantial, difficult and
  48.           doubtful questions." The Court further agreed that the CDA is
  49.           "unconstitutionally vague" as to the prosecution for indecency.
  50.           But the Court left open the possibility that the government
  51.           could prosecute under the "patently offensive" provisions.
  52.  
  53.           The court has recognized the critical problem with the CDA,
  54.           which is the attempt to apply the indecency standard to on-line
  55.           communications. Nonetheless, online speech remains at risk
  56.           because of the sweeping nature of the CDA.
  57.  
  58.           The entry of the court order is a strong indication that the
  59.           "indecency" provision of the legislation that went into effect
  60.           on February 8 will not survive constitutional scrutiny by a
  61.           three- judge panel that has been impaneled in Philadelphia. The
  62.           panel will fully evaluate the constitutional validity of the
  63.           legislation and consider entry of a permanent injunction
  64.           against enforcement of the new law.

  66.           According to EPIC Legal Counsel David Sobel, one of the
  67.           attorneys representing the coalition, "The court's decision is
  68.           a partial victory for free speech, but expression on the
  69.           Internet remains at risk. This is destined to become a landmark
  70.           case that will determine the future of the Internet." Looking
  71.           ahead to proceedings before the three-judge panel, Sobel said
  72.           "we are optimistic that further litigation of this case will
  73.           demonstrate to the court that the CDA, in its entirety, does
  74.           not pass constitutional muster."
